Powa Boxing Mobile App Privacy Policy

Powa Boxing Inc. (“Powa Boxing,” “we,” or “us”) is committed to protecting your privacy. This Privacy Policy explains what information we collect through the Powa Boxing mobile application (“App”), how we use and protect that data, your choices regarding your information, and your rights under U.S. privacy laws (including the California Consumer Privacy Act, or CCPA). By using the App, you agree to the data practices described in this policy.

Data Collection

Information We Collect and Why: We collect personal and usage information to provide and improve the App’s features. This includes:

  • Personal Identifiers: When you create an account, we may collect information like your name, email address, or username. This allows us to create your profile, personalize your experience, and communicate with you (for example, sending app updates or responding to support requests).

  • Fitness and Activity Data: The App records your boxing workout data (such as punch counts, speed, power scores, workout duration and frequency) to deliver feedback on your performance and track your progress over time. This health and fitness information is linked to your profile so that you can review your stats and improvements.

  • Device and Usage Information: We automatically receive certain technical data when you use the App, such as your device type, operating system, unique device identifiers, and in-app actions or log events. We use this data to ensure the App functions correctly, to debug issues, and to analyze usage trends so we can make improvements. This usage data is generally not linked to your identity.

  • Location Data (Optional): The App may request access to location services on your device. For example, on some devices, enabling Bluetooth for the punch sensors might require location permission. If collected, location data is used only to support App features (like connecting to nearby Bluetooth sensors) and is not stored in an identifiable way.

  • Contact Information (Optional): If you choose to provide additional contact details or communicate with us (such as sending an email or filling out a support form), we will collect whatever information you share (like your phone number or the contents of your message) to assist you and respond to your inquiries.

How We Use the Data: We only use your information for legitimate purposes in operating the App and our services. For example, we use your data to create and manage your account, record and display your workout results, send you progress updates or goal reminders, improve and personalize App features, and prevent fraud or misuse. We do not use the data for purposes unrelated to the App’s core functionality without your consent. If we ever want to use your information for new purposes (e.g. adding a new feature), we will update this policy and notify you as required.

Data Storage & Security

Storage: Your data is stored securely on our servers (and/or those of our cloud service providers). We retain personal information only as long as necessary to fulfill the purposes described in this policy or as required by law. For instance, as long as you maintain an account, we will keep your profile and workout history so you can access them. If you delete your account or request deletion of your data, we will remove or anonymize your information in accordance with Legal Rights below.

Security Measures: We take reasonable precautions to protect your data. This includes technical, administrative, and physical safeguards such as encryption of data in transit, secure servers with firewall protection, and access controls to limit who can view your information. We also regularly update our App and systems to address security vulnerabilities. While we strive to protect your personal data, please note that no method of transmission or storage is 100% secure. Therefore, we cannot guarantee absolute security of information. You share and use the App at your own risk, and you should also take steps to protect your device and account (like using a strong password and keeping it confidential).

User Choices

You have control over your data and the information you share with us. Here are the choices and options available to you regarding data collection and retention:

  • Profile Information: Providing certain personal information (like your name or email) is often optional. However, some features (for example, cloud backup of your workouts or social/leaderboard features) may require an account. You can choose how much information to include in your profile, and you may update or correct your profile details at any time in the App settings.

  • Device Permissions: You can control the App’s access to device features. For instance, you can choose whether to grant location or Bluetooth permissions. If you decline a permission request, the App will still work but some features may be limited (for example, not enabling Bluetooth will prevent connecting to the punch sensors). You can always adjust permissions later through your device settings.

  • Communications: If we send you promotional communications (such as newsletters or new feature announcements), you will have the ability to opt out or unsubscribe. Essential service or transaction messages (like password resets or important account notices) may still be sent if needed. We will not spam you – communications will be limited to relevant information about the App or your account.

  • Data Retention & Deletion: You may request deletion of your account and personal data at any time. This can be done by contacting us directly (see Contact Information below). Upon such a request, we will delete or de-identify the personal information we have about you, except where we are required or permitted by law to keep it (for example, for legal compliance or internal record-keeping).

  • Analytics/Tracking: We do not serve third-party ads in the App, but we may use analytics tools to understand usage. These tools might automatically collect usage data (as described above). In general, you cannot be individually identified from this analytics data, but if you wish to limit any data collection, you can contact us with your concerns. (At this time, the App does not respond to web browser “Do Not Track” signals, which typically apply to websites. Since our App does not track your online browsing, this is not applicable.)

Third-Party Sharing

We do not sell your personal information to third parties for profit. We only share your data in a few specific circumstances:

  • Service Providers: We employ trusted third-party companies to perform services on our behalf, such as cloud hosting, data analytics, or customer support tools. These providers may process or store your information for the purpose of assisting us, but they are contractually obligated to safeguard your data and cannot use it for their own purposes. For example, we might use a cloud database service to store account information or an analytics service (like Google Firebase Analytics) to understand app usage patterns. These third parties only access data as needed to provide their service to us.

  • Business Transactions: If Powa Boxing is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred to the succeeding entity. If such a transfer occurs, we will ensure the new owner continues to protect your data in accordance with this policy and applicable laws.

  • Legal Compliance and Safety: We may disclose information about you if we are required to do so by law or legal process (for example, in response to a court order or a valid subpoena). We may also share data if necessary to investigate or enforce legal rights or to protect the safety, rights, or property of our users, the public, or Powa Boxing. This includes exchanging information with law enforcement or others for fraud prevention or security threats, if appropriate.

  • With Your Consent: Aside from the situations above, we will only share your personal data with third parties when you give us your explicit consent to do so. For instance, if the App introduces a feature to share your boxing achievements on a social network or with a trainer, we would only do so if you choose to use that feature and authorize the sharing.

In all cases of sharing, we limit the information disclosed to what is reasonably necessary for that third party to carry out its responsibilities. We do not provide your personal information to unrelated companies for their independent marketing purposes.

Legal Rights (Your Privacy Rights)

Depending on where you live, you have certain legal rights over your personal information. Powa Boxing is committed to honoring these rights in compliance with U.S. privacy laws, especially for California residents under the CCPA. These rights include:

  • Right to Know/Access: You have the right to request that we disclose what personal information we have collected about you, including the categories of data, the sources of that data, the business purpose for collecting it, and the categories of third parties with whom we share it. You may also request a copy of the specific pieces of personal information we have about you.

  • Right to Delete: You have the right to request that we delete personal information we collected from you. Once we receive a verifiable request from you to delete, we will erase your personal data from our records (and instruct our service providers to do the same), unless retaining the information is permitted by an exception (for example, if we need certain data to comply with a legal obligation or to complete a transaction you requested).

  • Right to Opt-Out of Sale: The CCPA gives you the right to opt out of the sale or sharing of your personal information to third parties. As noted above, we do not sell your personal information. In the event we ever consider selling data, we will provide a clear “Do Not Sell My Personal Information” option and honor your choice.

  • Right to Correct (California Privacy Rights Act Addendum): If any personal information we hold about you is inaccurate or out-of-date, you have the right to request that we correct it. We will take commercially reasonable steps to verify and correct the information as needed.

  • Right to Non-Discrimination: We will never discriminate or retaliate against you for exercising any of these privacy rights. This means we won’t deny you our services, charge you different prices, or provide a lesser experience just because you exercised your rights under applicable privacy laws.

These rights are primarily available to California residents under the CCPA (as amended by the CPRA)

However, if you are a resident of another U.S. state that grants similar privacy rights (such as Virginia, Colorado, etc.), we will extend the same courtesy and comply with those laws as applicable. To exercise any of these rights, please follow the instructions in the Contact Information section below. We will need to verify your identity before fulfilling certain requests (for instance, by confirming information we have on file like your email address) to ensure we protect your information from unauthorized access. We will respond to your request within the timeframe required by law (generally within 45 days for CCPA requests, with an extension if needed which we will communicate to you).

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify users through the App or by other means so you can review the changes. Your continued use of the App after an update indicates your acceptance of the revised policy.
